Group Tours – Terms and Conditions
You are contracting with Voice of Guides (Agnes Simigh), Einzelunternehmen (solo entrepreneur) registered in Germany, with address 53340 Meckenheim Im Ruhrfeld 38, tax number 222/5101/5695.
The following conditions apply to you when you purchase individual or group travel through us.
The terms “we”, “our” and “travel organizer” refer to Voice of Guides (Agnes Simigh), Einzelunternehmen (solo entrepreneur). “You”, “traveler” refers to the customer.
ENTRY INTO EFFECT OF AGREEMENT
By booking the trip, registering and confirming the application, as well as paying the advance, the travel contract is established between the traveler/customer and the tour operator (Agnes Simigh- Voice of Guides).
The duration of the trip, the description and quality of the services and the participation fee are included in the program offer published on voiceofguides.com website and in the confirmation of the order.
The travel contract will only enter into force upon the fulfillment of all of the conditions listed above and upon receipt of the total participation fee in the tour operator’s bank account.
The condition for a valid travel contract to enter into force is that the total fee is received in the bank account of the travel organizer 30 days before the departure date specified in the contract.
The tour operator is not obliged to enter into a contract. The tour operator may reject the conclusion of a contract with the traveler/customer at any time without reason.
The traveler/customer must inform us of personal, special requests, wishes, and conditions related to the trip and his/her participation in it before concluding the travel contract.
BOOKING PROCESS
A deposit of €700 is required for travel and seat reservations, which must be paid within 15 working days of sending the booking information and payment details.
The remaining amount must be paid no later than 30 days before the start of the trip.
If the booking is made within 30 days before the trip, the full participation fee must be paid.
CANCELLATION POLICY
All cancellations must be made in writing, which will be effective the day received. The reimbursement of the price of the trip is calculated as follows:
If the 700 Euro advance is cancelled:
– The customer can use the full deposit amount (€700) as a credit for a future tour.
– We will refund you in full 60 days before the departure of the trip. If you cancel your reservation less than 60 days before the tour, the deposit will not be refunded.
If the remaining amount has already been paid, the following rule applies:
– 100% refund if cancelled 60 days before departure
– 70% refund if cancelled 45-60 days before departure
– 50% refund if cancelled 30-45 days before departure
– 0% refund if cancelled 0-29 days before departure
In case of any cancellation:
– The Customer is responsible for the transaction costs related to the refund.
– In the event that non-refundable costs and expenses arise, including but not limited to flight ticket and hotel reservations, we will deduct them from the refund due to the Csutomer.
– If circumstances force you to end the trip earlier, you (Customer) must bear all additional costs.
WAIVER BY US
We reserve the right to cancel the trip. However, we will only do this if we are forced to do so due to unforeseen circumstances, such as flight cancellations, political unrest or force majeure.
We will notify you of any minor changes before departure. If we consider it important to change the trip, we will notify you as soon as possible and give you the opportunity to accept the change, or to go on another trip (with payment of the price difference or a refund), or to cancel the trip with a full refund.
Under no circumstances will we be liable for the failure, damage or loss of your trip due to unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided with due care. We are not liable to pay you any additional travel or other costs, expenses or losses incurred as a result of any changes or cancellations made by us, such as changes to connecting flight times or other travel arrangements. You agree that these provisions are reasonable.
In the event that an airline cancels a flight and forces us to cancel a trip in whole or in part, we will only refund the amounts we can recover. It is the Customer’s responsibility to have adequate insurance to cover any additional losses.
PASSPORTS AND VISAS
We are not responsible for any costs incurred by the customer in getting to the planned departure point of the trip.
You are responsible to have a valid visa for the destination of your trip, where it is required.
Medical vaccinations, passports and visas are entirely your responsibility and should be arranged prior to departure. We are not responsible for the cancellation of the trip in the event that you are not allowed to fly or continue the trip. If you are unable to travel because you are unable to obtain (or do not have) the appropriate visa, we reserve the right to withhold the price of the trip.
FORCE MAJEURE
Force majeure is any event or circumstance that we could not foresee or avoid even with due care. Such events may include, but are not limited to, war, riots, civil strife, terrorist activity, natural or nuclear disasters, adverse weather or road conditions, fire, bureaucratic obstacles, flight cancellations and changes to ferry company schedules or modes of transportation, airlines, bus or rail companies and any similar event beyond our control.
If such an event or circumstance arises and the trip cannot be continued due to the given event or circumstance, the Customer is entitled to get a refund reduced by any reasonable costs incurred by us.
COVID 19
Agnes Simigh (Voice of Guides) is not responsible for additional Covid-19 treatment or hotel costs incurred. All customers are aware of the risks associated with Covid-19 travel and are fully responsible for taking precautions to control the spread of Covid-19.
TRAVEL INSURANCE
Voice of Guides waives all responsibility for damages resulting from the customer’s emotional distress or any kind of mental problem. We are not responsible for any event, including but not limited to delays, losses, accidents, personal injury, political unrest, illness, medical expenses or property damage that occurs during your trip.
Therefore, we require all of our customers to take out adequate insurance, which provides sufficient coverage for the customer and his/her relatives traveling with him/her in the event of any possible risk. It is your responsibility that the insurance includes, but is not limited to, medical and health coverage for injury on the road or sudden illness, 24-hour emergency service and assistance (including repatriation if you become too ill to continue the trip), cancellations, restrictions, coverage for lost and stolen property and personal liability insurance. You must contact your insurance company with any claim.
FINANCIAL GUARANTEE
At no additional cost to you, we provide full security for the money you pay us in the rare event of insolvency on our part.
This means that whatever amount of money you send to us is fully insured by R+V Versicherung AG, it is covered by one of the largest and oldest insurance companies in Germany.
This complies with the German travel regulations (BGB § 651k) and German legal regulations, guaranteeing the customer’s financial protection.
LOCAL LAWS
Passengers are obliged to comply with local laws and regulations at all times. To the best of our understanding of local laws, we are not responsible in any way and the customer assumes responsibility for any financial or other consequences of their actions.
Customers are obliged to comply with the instructions and company rules of Voiceof Guides at all times.
If the traveler’s intentional or grossly negligent behavior endangers or violates the peace, health, safety, interests of his fellow passengers, the travel contract and the fulfillment of the program, and does not behave as expected, then after a warning, the tour operator is entitled to exclude the traveler from the trip with immediate effect, to cancel the travel contract, and the traveler is obliged to take care of his travel back home. In this case, Voice of Guides may demand compensation from the traveler for damages resulting from the cancellation of the travel contract.
DISCLAIMER OF CHANGES
Voice of Guides reserves the right to change these terms and conditions at any time and we will notify our customers if such changes are made.
Prices are subject to change without prior notice and are not binding until the booking is confirmed.
Although we do our best to keep the itineraries and programs as described, Voice of Guides reserves the right to change the itinerary in case of unforeseen events. We reserve the right to modify or change all itineraries on a case-by-case basis depending on the on-site situation. In such cases, we always provide a suitable replacement.
We will offer a replacement service of the same quality as specified in the contract, if this is possible. Voice of Guides reserves the right to change the accommodation within the category, as well as to exchange programs with programs of equal value in exceptional cases, if this is forced by factors beyond our control.
Train and flight tickets are subject to availability. We reserve the right to change the transport method depending on availability.
There is no guarantee that the vehicle used during the trip will depart at the specified time. If not, we will not be liable for any delay or cancellation or failure to act in a way you think it would have been the best under the given circumstances.
If for any reason the customer does not complete part of their trip or leaves their scheduled tour after departure, no refund will be given and no credit will be given for future trips.
ACCEPTANCE OF RISK
The passenger fully accepts and understands the possible risks associated with travel and undertakes to assume these risks of his own free will. The Customer acknowledges that participating in the trip entails significant personal risk. The Customer accepts and agrees to the personal risks, and considers and accepts the limitations of the tour operator’s liability defined here as reasonable. Especially because of the additional risks associated with traveling in the countries/regions of Iraq and other countries, which are not recommended by the foreign ministries of the German and many other governments. Furthermore, the Customer accepts that in many places the hygiene, quality of accommodation, security and law enforcement may be worse compared to what is usual at home.
In the case of the above-mentioned countries, if the passenger is subject to a travel warning issued by the German Ministry of Foreign Affairs (Auswärtiges Amt / Reisewarnungen), insurances do not apply in case of war, terrorism, civil unrest, protests, general strikes and nature catastrophes. In this case, the travel organizer is not responsible for the consequences arising from these reasons. We consider that the passenger has been reasonably informed about the current situation in the countries to which they are traveling and has made their own decision to travel.
PAYMENT
The price of the trip and the currency of payment published on our website (voiceofguides.com) are not guaranteed, and until the customer pays the balance, Voice of Guides reserves the right to change the price of the trip and refuse to accept payment in certain currency.
Depending on the country, the local tour operator may not be able to accept direct payments, in which case the remaining amount must be paid in cash on the spot.
